Brain Injuries
Mintons have extensive experience in dealing with claims involving brain injuries of varying degrees. These include children who are brain damaged at birth due to medical complications during labour and delivery.
The following are some examples of cases which have settled:-
- Settlement on a full liability basis equating to £4 million involving a child who sustained birth asphyxia and was left with cerebral palsy.
- £2,575 million in respect of a child who sustained a significant brain injury following a negligent delivery.
- £1.5 million for a child who suffered brain damage following an incorrect decision to extubate prematurely after heart surgery leaving him handicapped and dependent upon others for his care needs.
- £1 million for a 21 year old who suffered from learning difficulties following treatment at birth and where we were instructed almost 18 years after he was born.
- £250,000 for a child who had mild cerebral palsy leading to problems with fine skill abilities consequent upon mismanagement of his mother’s labour.
- £250,000 following injury after vaccination.
Spinal Injuries
- £1.1 million for a young man who sustained serious injuries including to his spinal cord following a road traffic accident.
- £225,000 for spinal cord damage, which would have been avoided had the Claimant undergone appropriate surgery earlier.
Head Injuries
- £125,000 for negligently failing to operate leading to a woman suffering from unnecessary and regular fitting/epilepsy for a period of five years.
- £100,000 for failing to provide accurate information following the embolisation of two aneurysms which led to the Claimant suffering and developing left sided heamaplegia.
Ophthalmic
- £300,000, for a young man who was treated with excessive amounts of oxygen which left him blind.
- £80,000 in respect of a Claimant who was left with double vision following laser surgery.
- £60,000 for visual loss consequent upon the Claimant not receiving prompt treatment following an ophthalmic emergency.
- £30,000 for failing to provide a Claimant with a prompt ophthalmic appointment causing her to virtually lose sight in one of her eyes.
- £30,000 for failing to diagnose that the Claimant had glaucoma which resulted in virtually the loss of sight in one of her eyes.
Erb’s Palsy
- £60,000 for a child who sustained a left brachial plexus injury at birth.
Failure to Diagnose
- An award of £45,000 for failing to diagnose that the Claimant’s wife had a tumour in her right frontal lobe and who subsequently died.
Surgical
- £40,000 following a perforated bowel during surgery.
- £50,000 following the delayed diagnosis of Deep Vein Thrombosis
Gynaecological
- £35,000 due to a traumatic injury to the left external iliac artery during an operation to remove ovaries.
- £24,000 following the perforation of a uterus and bladder.
Dental Claims
- Mintons have resolved numerous dental claims ranging from £17,000 for additional dental treatment to the recovery of £2,000 in respect of a Claimant who required unnecessary dental treatment.
